    Terms and Conditions

  1. Overview
    1. These Terms and Conditions of the company Codebase Consulting Ltd (hereinafter referred to as "we, us, our" shall apply to all contracts concluded between a customer (hereinafter referred to as "client, you, your").
    2. These terms are in addition to our general terms and conditions and relate specifically to domain name registrations managed by us. You agree to these terms as well as relevant 3rd party terms when registering domains with us.
    3. We reserve the right to update or amend these terms at any time, without notice. Any changes will be published on our website. Your continued use of your domain name will constitute your acceptance of this agreement.
    4. This agreement is binding for the duration of the domain name registration period. Renewal of your domain name signifies your continued agreement of these terms.
    5. If the domain is transferred or deleted this agreement shall cease.
  2. Our Responsibilities
    1. Process your application to register or renew a domain name.
    2. Maintain ownership, control and responsibility for you.
    3. Make changes to your domain name in accordance with your instruction to change, transfer or cancel your domain name.
    4. Provide (if required) the management, confirmation and changes to name server entry's in accordance with industry best practise.
  3. Customer Responsibilities
    1. You are obliged to provide the following when requesting a domain name:
      1. Your name, postal address, phone number and email contact information.
      2. The domain name being registered.
      3. Any other information required to register the domain.
    2. You must maintain all information to ensure it remains accurate.
    3. Pay us the domain fee's directly in accordance with the invoice instruction.
  4. Registration
    1. We cannot guarantee availability of a domain name, even if a search indicates that it is available.
    2. We will accept new domain registrations once payment has been processed. However, until the domain name is showing as registered with your details via a WHOIS (https://who.is) search, we do not guarantee that your domain name has been secured.
    3. You shall have no right to bring any claim against us in respect of any refusal to register a domain name by the relevant registration authority.
  5. Duration, Renewals and Transfers
    1. We will register your domain name for a period between one and ten years in accordance with your requirements. You may renew your Domain Name at the end of its term in accordance with our renewals processes.
    2. Reminders for domain renewals will be sent to the client 60 days before the renewal date. If these are not acted upon, further reminders are sent 30 days before with a final reminder at 7 days before renewal or expiry. If we do not hear from you or you no longer require the use of the domain, it will expire.
    3. Should you wish to transfer a domain to a new registrar we will not charge for the service.
    4. We shall not release any domain to another provider unless full payment for that domain has been received by us.
  6. Domain Expiry
    1. If a domain name is not renewed by the expiry date it will stop resolving and will be marked as expired.
    2. If we are unable to take payment or payment is not received within the required time-frame, the domain will expire and will not be renewed.
    3. It is your responsibility to ensure your contact information is up to date to ensure renewal reminders are received.
    4. If you fail to renew your domain registration, your domain may cease to resolve and visitors to your site may be directed to a default page informing them that the domain has expired.
    5. It may be possible to recover a domain name after it has expired however we cannot guarantee that attempted renewals will be successful.
    6. If you forfeit a domain name due to non-payment, we will have the right to:
      1. Register and use the domain name for its other purposes;
      2. Sell or transfer the domain name to a third-party; or
      3. Delete the domain name making it immediately available for registration by anyone.
  7. Payments
    1. We do not have to start the purchase or transfer process until we have received the payment in full.
    2. We may cancel (or lapse) your domain name if any debt relating to your domain name remains unpaid after the due date for payment has passed.
    3. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the Registry to register your desired name.
  8. Liability
    1. We shall have no liability in respect of the use by you of any domain name.
    2. Any dispute between you and any other person must be resolved between the parties concerned in such dispute.
  9. WHOIS
    1. You agree and acknowledge that we will make domain name registration information you provide available to ICANN, the registry operator, law enforcement agencies and other third parties as applicable.
    2. You acknowledge that we will make the domain name registration information publicly available to third party vendors for the purpose of inspection (Such as who.is).
  10. Third Party Terms and Conditions
    1. The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant Registry; you shall ensure that you are aware of those terms and conditions and that you comply with them.
